To initiate Khula in Pakistan, a woman must file a Khula petition in the Family Court through a lawyer. The petition must state the reasons for seeking divorce and provide relevant supporting documents. The court then issues a notice to the husband, allowing him the opportunity to respond. If reconciliation efforts fail, and the wife remains firm in her decision, the court grants a Khula decree. Once the decree is issued, the Union Council completes the legal process by updating the marital status and issuing a Divorce Certificate.

Role of Haq Mehr in Khula Cases

One important aspect of Talaq in Pakistan is the return of Haq Mehr (dower). In most cases, the wife must forfeit part or all of her Haq Mehr as a condition for obtaining Khula, as per Islamic principles. However, if the husband has mistreated or harmed the wife, the court may allow her to seek Khula without returning Haq Mehr. The court evaluates the circumstances and ensures that justice is served while finalizing the divorce.

Timeframe and Legal Implications of Khula

The entire Khula process in Pakistan can take anywhere from three months to a year, depending on the complexity of the case and the response of the husband. Once the Khula decree is granted, the wife must observe Iddah (waiting period) for three months before she is legally free to remarry. This period ensures that there are no disputes regarding pregnancy or marital rights. The Divorce Certificate issued by NADRA serves as legal proof of separation and is required for official documentation updates.
